A Marital Settlement Agreement (MSA) is a signed, written agreement between two divorcing spouses that provides a comprehensive resolution to all legal matters involved in the divorce. A carefully drafted agreement can save a lot of money, time, and provide a more satisfactory compromise than would be accomplished by fighting a court battle and giving up the power of decision to a judge.
Drafting, signing, and submitting a Marital Settlement Agreement to the court may be a viable option for you if you and your spouse are able to communicate productively and/or are willing to work with a mediator, arbitrator, or collaborative divorce professionals. Divorces settled with good agreements tend to work out better in the long run. There is usually more cooperation with support payments, custody and visitation, and co-parenting.
A settlement agreement may also be drafted for particular issues within the divorce process. For example, you and your spouse may readily agree on custody and visitation and would like to write up that agreement and present it to the court. However, the two of you may be unable to come to an agreement regarding property division and so submit that issue to the court to decide.
